Terms of Service

2.1 What we provide

ModelFold is a multi-model AI API platform for developers and teams. Through one unified API and a web Playground, you can call third-party AI models for video generation, image generation, chat and speech, with API key management, a credit wallet and usage records. The Service is a digital software-as-a-service (SaaS) product delivered over the internet.

2.2 Nature of the Service

The Service is an intangible digital product. Credits are added to your account immediately after payment is confirmed. Because of this immediate digital delivery, refunds are subject to the limits in Section 7.

2.3 Third-party AI models

The Service relies on third-party AI model providers, including OpenAI, Anthropic, Google, xAI, ByteDance, Kuaishou, Alibaba, Black Forest Labs and ElevenLabs. Model availability, performance and output are affected by these providers. We will notify users of significant outages. If an upstream task fails, the credits charged for it are refunded automatically.

3.1 Account creation

You must create an account with accurate and complete information. You are responsible for keeping your password, API keys and other credentials confidential, and for all activity under your account and API keys.

3.2 Account security

• If you notice unauthorized use, revoke the affected API keys in your account immediately and contact support@modelfold.online.
• Do not share your login credentials or API keys with any third party.
• Keep your account email address valid.

3.3 Business accounts

If you register on behalf of a company or organization, you represent that you are authorized to bind that entity to these Terms.

5.1 One-time purchase authorization

Each top-up is a one-time transaction. The Service does not offer subscriptions or automatic renewals. By completing a purchase, you authorize the charge of the amount shown at checkout to your payment method.

5.2 Payment processing and taxes

Payments are processed by our payment provider Waffo Pancake acting as Merchant of Record, and the transaction may appear under its name on your statement. The price shown at checkout is the final amount you pay; applicable taxes are collected and remitted by Waffo Pancake as required by law.

6.1 Credit validity

Purchased credits do not expire while your account remains active.

6.2 Account termination

If your account is terminated (by you or by us), unused credits are kept for 30 days after termination, during which you may contact us about them. After that period, unused credits expire and are non-refundable unless otherwise required by applicable law.

9.1 Ownership of output

Subject to these Terms, AI content generated from your input ("Output") belongs to you. You may use Output for any lawful purpose permitted under Section 10.

9.2 License to input

By submitting content to the Service ("Input"), you grant us a limited, non-exclusive license to use it solely to provide the Service to you, including sending it to the relevant model provider. We will not use your Input to train AI models without your explicit consent.

9.3 Third-party AI models

Output is generated by the third-party models listed in Section 2.3 and may be affected by their characteristics. We do not guarantee any particular output quality and are not responsible for content generated by third-party models. All model names and trademarks belong to their respective owners; ModelFold is not affiliated with these providers.

9.4 Accuracy of AI output

AI-generated content may contain errors or inaccuracies. You are responsible for reviewing and verifying Output before relying on or publishing it.

10.1 Permitted use

You may use the Service only for lawful purposes in accordance with these Terms. This policy applies to all content generated, uploaded or distributed through the Service, including text, images, audio (including text-to-speech), video (including image-to-video) and the prompts you submit.

10.2 Content standards and prohibited categories

You must not use the Service to generate the following six categories of content:

• Pornography / NSFW: any sexually explicit content, nudity or pornographic material.
• Violence / gore: content that promotes, glorifies or graphically depicts violence, abuse, self-harm or gore, or that incites or facilitates violence.
• Hate speech: content that attacks, demeans, discriminates against or incites hatred toward people based on race, ethnicity, religion, gender, sexual orientation, disability, nationality or similar characteristics.
• Child-unsafe content (CSAM): any sexual content involving minors or sexualization of minors. Zero tolerance — accounts are banned immediately and reported to the authorities as required by law.
• Deepfakes / impersonation: images, video or voice that impersonate real people (including face swaps, "nudify", intimate-scene compositing or fabricated statements or actions), or impersonation of other people, brands or organizations, whether or not the people involved consent.
• Copyright / trademark infringement: unauthorized reproduction or imitation of copyrighted or trademarked works, characters or logos, or other infringement of intellectual property, publicity or privacy rights.

10.3 Other prohibited use

You agree not to use the Service to:

• Generate illegal, defamatory, harassing or fraudulent content.
• Create, distribute or assist in creating deepfakes, including AI-synthesized audio, video or images that impersonate real people or are intended to mislead viewers about their source or authenticity — including face swap, "nudify" or intimate-scene compositing features, whether or not the people involved consent.
• Upload photos, voices or videos of real people without their authorization in order to generate content.
• Generate content that sexualizes minors or violates child-protection laws.
• Create malware, phishing content or cyber-attack tools.
• Infringe the intellectual property or privacy rights of any third party.
• Attack, scan, bypass rate limits of, or otherwise interfere with the security features of the Service or upstream services.
• Resell or sublicense access without our prior written approval.
• Violate any applicable law, regulation or card network rule.

10.4 AI-specific restrictions

Given the AI nature of the Service, you expressly agree not to:

• Use Input, Output, model responses or any derived data to train, fine-tune, benchmark, distill or otherwise develop any AI or machine-learning model that competes with the Service.
• Systematically scrape, extract or harvest model outputs at scale for any purpose beyond your own authorized use.
• Present AI-generated content as the work of a human professional (such as a licensed physician, lawyer or financial advisor) where doing so could cause harm.

10.5 Content moderation

Generation requests pass through the content-safety filters of the underlying model providers (rules are set by each provider), and requests flagged as violating are rejected. We manually review content reported by users and may apply additional safety checks to prompts and outputs.

10.6 Reporting violations and how we handle reports

If you find violating content generated through the Service (including content that impersonates you or infringes your rights), email support@modelfold.online with the subject "Content report", including the content, link or screenshot, the time it was generated and your contact details. Reporter identity is kept strictly confidential; malicious or false reports are recorded and actioned. Process and timelines:

• We acknowledge every report within 1 business day.
• Severe illegal content such as child-safety violations: actioned within 24 hours, the account banned and reported to the authorities as required by law.
• Other violations: reviewed and actioned within 3 business days in most cases.
• Depending on severity, actions include a warning, content removal, feature restriction, account suspension, permanent ban, and reporting to the authorities.
• We email the reporter once the report has been resolved.

10.7 Appeals

If you disagree with an action taken on your account, email support@modelfold.online with the subject "Appeal" within 14 days of the notice. Appeals are reviewed by someone not involved in the original decision, and we respond within 10 business days.

12.1 Disclaimer

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or accuracy of AI output.

12.2 AI-generated content disclaimer

AI output from the Service may be inaccurate, incomplete or out of date. Do not use it as legal, medical, financial or other professional advice. Always verify with a qualified professional before acting on AI content.

12.3 Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, consequential or punitive damages. Our total liability is limited to the amount you paid us in the 12 months before the event giving rise to the claim.
